An Alderley Edge business will have to apply for planning permission to continue to host the Alderley Edge Farmer's Market at their premises.
Following complaints from residents of Lynton Lane, regarding disturbances, Cheshire East Council's Planning Enforcement Department have made a visit to Aldeli.
CEC officers visited the Wilmslow Road premises recently "to look at the issues raised by residents, including noise, odour, smoke issues associated with the farmer's market and the use of the brick built oven - to establish whether a statutory nuisance exists".
Following the visit the owners of Aldeli were informed that planning permission is required to host the monthly farmer's market.
Cheshire East Council has also confirmed that planning permission is required for the recently built brick barbecue oven, and if Aldeli do not submit a retrospective planning application then the structure will have to be removed.
Stephen Higham told alderleyedge.com "I wasn't aware that I needed planning permission for either. I am seeking professional advice and will do whatever is necessary. I do not want to be breaking any planning laws."
The Alderley Edge Farmer's Market moved to Aldeli in April this year, having previously been held at the Festival Hall.
Christine Munro, who has organised the market for 13 years, said "We moved because the farmers and producers felt that customers prefer an outdoor market which gives a better atmosphere and more visibility to passing customers.
"We had organised the Christmas Market in the village and although it absolutely poured with rain all our producers had had a good day and enjoyed being part of the village.
"Unfortunately we weren't able to hold another event in the village and so I had to look for another location."
Christine added "Stephen and his family make us very welcome, the atmosphere is great, and he sets up his BBQ and we provide live music too on occasions.
"We can't have as many producers at Aldeli as we had at The Festival Hall but I try where possible to select producers who won't clash with each other so there is plenty of variety on the market."

Here's what readers have had to say so far. Why not add your thoughts below.
A case of some people in the village just doing whatever they want to make money
On a still day you can here the children playing in the playground at the
school over the road from Lynton Lane....... have the residents been on to
the appropriate agencies over this yet. Grounds for a moan next time they
need an excuse.
We enjoy doing this market simply because our bees are in the village .
Determined to see Alderley Edge becoming a ghost town!
I agree with Steve above 'shame on them'
Ha ha
Some people may have nothing better to do,but some will work all week and won't be wanting half the village descending on them once a month.
Maybe the likes of Sarah lane,Steve Scott,John Morris,Paul davies, and not forgetting Nick, would all like to apply for planning for the markets outside there property.
For goodness sake it is once a month for a few hours ...get a life!
