A man has been found guilty of causing the death of an 11 year old boy by driving carelessly on the Alderley Edge bypass.
Chester Crown Court heard that Hassan Maan, 30, had been involved in a head on collision with another car on the A34 in Alderley Edge around 8am on 16 September 2013.
The red Porsche he was driving crossed into the opposite carriageway on a bend in the road and into the path of a Ford Focus being driven by Nicola Clifford.
Mrs Clifford had been taking her two sons to school. One was a front seat passenger, the other, 11 year old Flynn Morrissey, was in the back.
Sadly Flynn sustained fatal injuries in the head on collision. All three had been wearing seatbelts.
Flynn had started at Wilmslow High School two weeks earlier, having previously attended Pownall Hall School.
There were several witnesses to the collision who told police that they had seen the car cross the centre of the road, into the path of the Ford Focus.
Maan, of Eton Drive in Cheadle, claimed that he had lost control of his car because it "aqua-planed" on a patch of water on the road. He claimed it had been raining heavily.
However, many other drivers who witnessed the accident and had been driving on the same stretch, told police that the rain had been light.
They did not recall a pool or patch of water on the road and the road conditions had not caused them to lose control of their vehicles in a similar way.
One of the witnesses told the court that Maan had said to him, immediately after the crash, "I don't know what happened, the car just went straight on."
A judge at Chester Crown Court today (Friday 13th February) sentenced Maan to a 12 month community order, 150 hours of unpaid work, ordered him to pay £4,200 costs and disqualified him from driving for 12 months.
Gary Simpson, Senior Crown Prosecutor with Mersey-Cheshire Crown Prosecution Serice, said: "This is a tragic case. The death of the eleven year old boy has devastated his family.
"The Prosecution's case was that Maan drove carelessly, so carelessly that he lost control of his vehicle and drove into the oncoming traffic.
"It was raining at the time but no other drivers had lost control of their cars in a similar way.
"Our thoughts remain with Mrs Clifford and her family at this very difficult time."
